Why UP RERA Called This Webinar Now
UP RERA has scheduled an Online Webinar with Real Estate Agents on 13 August 2026, and the single word attached to it is Statutory Compliance. The timing is deliberate. The authority published its H1 2026 Half-Yearly Report showing ₹2,173.78 crore recovered across 8,212 cases. That number tells you enforcement is not slowing down.
Three pressures converge this month. The 12th Amendment has consolidated the UP RERA Rules and General Regulations into their current form. The mandatory certification cycle, set in motion by the order dated 5 January 2026, is running toward its 31 December 2026 deadline. And recovery proceedings are active across the state.
When a regulator re-briefs registered intermediaries on duties they already carry, it is signalling where inspections and penalties will land next. This webinar is a warning shot as much as a training session. Every property broker facilitating transactions in UP should treat the seven duties below as a live checklist, not background reading.
Duties 1 and 2: Valid Registration and No Unregistered Projects
Section 9 of the RERA Act requires every real estate agent to hold valid registration before facilitating any sale or purchase. In Uttar Pradesh, that now carries a second condition. The training certificate from a notified institute must be in hand. An agent facilitating a transaction without both a live registration and the certificate is exposed the moment an inspection opens.
Section 10(a) is the harder line. You cannot facilitate the sale of a project, or any unit in it, that is not registered with the authority where registration is required. This is where many property advisors get caught. Selling for a developer whose registration has lapsed, or whose project was never registered, makes the intermediary a party to the violation.
Before you take on any inventory, verify the project registration number on up-rera.in. If it is not there, you do not touch the transaction. Penalty exposure under Section 62 runs up to ₹10,000 per day, capped at 5% of the property cost. You can model that figure using the RERA penalty calculator before you learn it the expensive way.
Duties 3 and 4: Books of Account and No False Representation
Section 10(b) requires you to maintain and preserve books of account, records and documents relating to transactions you facilitate. Under the UP RERA Rules, 2018, these must be available for inspection by the allottee or promoter you deal with. A registered intermediary who cannot produce a clean record of what was represented, what was paid, and what was promised is defenceless in a complaint.
Section 10(c) prohibits false or misleading representation of any service. This covers verbal assurances about possession dates, amenities, or approvals that the sanctioned plan does not support. If you tell a buyer the club house is coming and it is not in the registered project, that statement follows you into a proceeding.
Use the registered Agreement for Sale as your reference point for what can and cannot be promised. Keep every advertisement, brochure and WhatsApp message that formed part of the deal. When the regulator asks for records, silence is treated as evidence against the property broker, not for them.
Duties 5 and 6: No Unfair Trade Practice and Mandatory RERA Number Display
Section 10(d) bars unfair trade practices. The Act spells these out: falsely representing standards or grades, misleading advertising, and stating that services have approvals or sponsorships they do not have. Overstating carpet area, or blurring the line between carpet, built-up and super built-up, falls squarely here. If a client questions a number, you should be able to show the working. The display duty is the one most consultants underestimate. UP RERA requires the agent registration number to appear in all communications and advertisements connected to a facilitated transaction. That means listings, hoardings, printed material and digital posts. An advertisement without the RERA number is itself a violation, independent of anything else you did right.
Audit your own marketing this week. A single non-compliant post, screenshotted during a complaint, converts a clean deal into a penalty case running at up to ₹10,000 per day under Section 62.
Duty 7: Cooperating With Inspections and Proceedings
The seventh duty is procedural but it decides how every other duty is judged. UP RERA can call for records, summon an intermediary, and conduct inspections under its General Regulations as consolidated to the 12th Amendment. A property advisor who cooperates, produces documents on time and responds to notices is treated very differently from one who stalls.
The 8,212 recovery cases in the H1 2026 report did not appear from nowhere. They came from complaints, inspections and proceedings where the authority examined whether the agent met the Section 9 and 10 obligations. Non-cooperation is read as an admission that something is wrong.
Practical step: nominate a single point of contact for any UP RERA correspondence and check the portal regularly. Missing a notice because it went to an old email is not a defence. When the authority moves from a webinar reminder to an enforcement notice, the window to correct course is short, and the daily penalty clock does not pause while you find your paperwork.
The 31 December 2026 Certification Deadline
Every compliance duty above sits on top of one hard date. Already-registered agents must complete the mandatory certification by 31 December 2026. Miss it, and your registration and any renewal or amendment application are affected. This is the action item the webinar is nudging you toward.
The training is a four-day non-residential programme run by UP RERA's notified institutes, including NIET Greater Noida and collaborating universities such as India Literacy Board and Kanpur University. There is a competency examination on the final day. This is a state programme. It is not conducted by IBPS, which runs the MahaRERA exam in Maharashtra, so ignore any coaching that tells you otherwise.
The exact question count, time limit and pass mark for the UP exam are not publicly confirmed. Check up-rera.in for the current position rather than trusting secondhand figures. The seven statutory duties are not just field obligations. They are the spine of the certification exam syllabus.
